UK Tenancy Deposit Protection: The 30-Day Rule Landlords Can't Miss

Missing the UK's deposit protection deadline is one of the most expensive compliance mistakes a landlord can make — and there's no grace period for overseas landlords managing a UK rental remotely.

This Banke guide covers what's required.

The 30-Day Deadline

A tenant's deposit must be protected in a government-approved scheme within 30 calendar days of receiving it. This is absolute — no extensions, no grace periods, no exceptions for administrative delays. The clock starts the moment you or your agent receives the money, not from the tenancy start date or signing.

Two Separate Obligations

Within that same 30-day window, landlords must both protect the deposit and provide the tenant with prescribed information — details of the scheme used, end-of-tenancy procedures, and the dispute resolution process. Doing one without the other doesn't satisfy the requirement.

The Three Approved Schemes

Deposits must go into one of three government-authorised schemes: the Deposit Protection Service, MyDeposits, or the Tenancy Deposit Scheme.

What Non-Compliance Costs

If a court finds protection or information requirements weren't met, it must order the landlord to pay between one and three times the deposit — a meaningful financial penalty on top of returning the deposit itself.

Using a Letting Agent Doesn't Shift Liability

If you instruct an agent to manage the deposit and they fail to protect it or serve the prescribed information in time, the legal liability still sits with you as landlord — worth confirming compliance directly rather than assuming it's handled.
